Dividing Property and Protecting Assets in Divorce
New Jersey divorce law generally requires division of all assets acquired during the marriage. There are a few exceptions to this rule — inheritance received by one spouse and gifts received from a third party being two of them.
For those involved in high-asset divorce cases where substantial assets were acquired during the marriage, the timing of the filing for dissolution, as well as the timing of the final decree, may greatly affect the distribution of those assets.
It is critical to understand that even once a complaint for divorce is filed, a determination must later be made as to whether any diminution or growth of assets is due to passive or active circumstances, as the court treats such changes to values of assets differently. I will fully explain to you how the law treats such appreciation of assets at time of distribution.
